You don't have to be a supreme court judge to know a "NO-BRAINER" when you hear of one. Supreme Court nominee Sonia Sotomayor qualifies as the legislate-from-the-bench poster child. The supreme court narrowly overturned a decision made in a lower court by Sotomayor.
